Open games and challenges can now be non-rated (no matter the outcome the ratings of the players will not change) and optionally start from a given FEN position. Note that set-position games are always non-rated, I'm not sure if it makes sense to allow rated set-position games. If you have an opinion please post it here.
Tournaments starting from a position are coming soon too.

I think I'm not going to allow checkmate on the first move, if not the opponent never gets a chance to accept/reject the challenge.

You should check for unwinnable positions too - otherwise someone could start a game with just two kings!
Wouldn't it be easier to have a library of 'approved' FEN positions and let people choose from them?
