Even if someone is aware of the rule it may be advantagious to repeat a position (second occurance not third) whent playing for a win. If trying to make a time control like 40 moves in 2 hours repeating a position gets you a move closer. In a sudden death time control ie 10 days for all moves or game/30 min. repeating a position can put extra stress on your opponent who is in time trouble. Also if time is equal but you repeat a position faster than your opponent you gain an advantage.
