Once, you have a point, as usual. And an attention to detail that would befit any good janitor.
However, there is a 'claim draw' option if the system detects that the conditions of a triple repeat of position or fifty move rule have been met.
Offering a draw, the option you get with every move you make, is usually seen as a sign of weakness, and quite often not taken up upon. The opponent might actually start looking harder for the winning move that is implied by such an offer. They may even find it!
In any case, there is such a thing as a mateless and stalemateless draw in chess. Given the sad fact of foot draggers on this site, it might be a good idea if these situations were also included in the options for claiming a draw.
One of the motivations for delaying an inevitable loss for as long as possible, or denying a dead draw, might have to do with the effect on a players' rating at the time. As such, it might be a good idea to drop the rating system entirely, but keep the 'Stats'. Tournaments could be based on amount of wins, rather than on ratings. Or on games played thus far (i.e. newbies, regulars, veterans, old timers, maniacs with no personal contacts left). Myself, I would like a tournament to be based on a combination of 'average time taken per move' and 'average total time before conclusion of game'. This would separate the patient from the impatient players to everyone's relief.
Besides, a rating only really makes sense if there is an outside to compare it with. Site-only ratings like we have here are not much more than an ego crutch to help keep the regulars interested.

Not really. It makes total sense within the structure of the site. At some point in time, assuming a player is not getting consistently better, their rating will settle down.
Now, while I don't mind playing people that are much stronger or much weaker players, I also don't always want to play on either extreme. Ratings help me play others that have similar strengths (rating) to me. Well, I actually think my true rating on this site should be in the 1750-1850 range but even with what may be inflation I think the idea holds true.
Ratings, for me at least, make sense and are a useful indicator of relative playing strength.
