yes,the rule is :if you have in a game tree times the same position with the same player to move,the game is drawn by treefold repetition.

Well it seems that it isn't programmed into the site. I have a game that has reached the same positions more than thrice already.

No, the server does not enforce the repetition rules yet. Please ask your opponent to accept your draw and if he/she doesn't want I'll help you from my side.
It is in my plans to automatically detect the repetitions, both the 3 and the 50 rules and also the draw by insufficient material. All these will be added in the future.

It's ok now, we finally agreed to a draw when it became clear neither one of us was going to change their move.
