If you check his games, you'll find he's losing a bunch from time expired. Looks like he's been gone a while and isn't in a hurry to come back. It's up to you, of course, but I'd just take the game in this case.

Is there a way to tell how long ago the time expired on any game?

Another possible exeption is if your opponent contacts you. I had one send me a message requesting me to allow him time because he had computer problems and was out of vacation. As it turned out he moved before the game ran out but I was prepared to wait for a short while. I lost that one too!!
